Information pursuant to § 11 Insurance Mediation Ordinance
An insurance broker requires a permit under § 34 d GewO and registration in the intermediaries register as of 1 January 2009. Disclosure is a mandatory duty.
Status under the Trade Regulation Act:
As insurance brokers and investment advisors, we act as independent and non-tied representatives of Smarter Finance 24 GmbH (hereafter: Smarter Finance). Smarter Finance 24 GmbH is a financial and insurance broker pool acting as a commercial broker in accordance with § 93 HGB in the field of insurance mediation as an insurance broker pursuant to § 34 d para. 1 of the Trade Regulation Act and in the field of financial investment mediation pursuant to § 34 f para. 1 sentence 1 no. 1 (investment funds) of the Trade Regulation Act. Smarter Finance is not obliged to broker or service contracts on behalf of particular product providers, but acts in the interest of its clients. The intermediary likewise acts in the client's interest as an insurance broker with a permit under § 34 d para. 1 GewO and as a financial investment intermediary with a permit under § 34 f para. 1 sentence 1 no. 1 (investment funds) GewO. In connection with the mediation, Smarter Finance and the intermediary acting for Smarter Finance provide advice in accordance with the statutory requirements and receive a commission and, if applicable, a service fee from the product provider for the successful mediation of an insurance contract. This commission is not paid separately by the client to Smarter Finance or to the intermediary; it is already included in the insurance premium. The recommendation and advice of Smarter Finance 24 GmbH are objective, balanced and based on a sufficient number of insurance tariffs and investment funds from various providers offered on the market. The basis for the decisions are, in addition to the client's personal wishes and objectives, further information provided in particular within the framework of the risk analysis. A complete overview of the insurance and investment companies can be provided on request. Should advice be provided in individual cases on the basis of a restricted market selection, this will only occur at the express request of the client or the intermediary will inform the client of this separately before providing advice.
